DESCRIPTION
The Compliance Lunch Debate, titled “Product Advertising & Consumer Protection”, will address the growing challenge of aligning product design and advertising with consumer protection in a landscape shaped by evolving regulations and digitalisation.
In practice, institutions are increasingly confronted with the overlap between general consumer protection rules and sector-specific requirements (MiFID, IDD, Consumer Credit Directive, PSD/PSR, National Acts & Decrees). This makes it more complex to determine which framework applies and how to ensure consistent, compliant and effective advertising across products and distribution channels.
Supervisory expectations at both European and national level, including from the FSMA, are evolving rapidly. There is a growing focus on how institutions present key information to consumers, how products are combined and priced, and how digital channels are used to communicate with clients. Particular attention is also being paid to the consistency between marketing materials, contractual documentation and the actual characteristics of the products offered.
These developments reflect a broader shift towards outcome-based supervision, where institutions are expected not only to comply with formal requirements but also to demonstrate that their communications are fair, clear and not misleading in practice.
